Japanese Knotweed Claims
Since a landmark court case in Maesteg, South Wales, there has been an increase in Japanese knotweed encroachment claims by homeowners. AJK have been involved in several cases acting on behalf of both homeowners bringing a claim against adjacent landowners and on behalf of landowners defending claims. As an independent surveying company if we recommend works are required our advice can be trusted as we do not commercially benefit from the physical works and have no commercial links to contractors. To date the types of cases we have been involved with are as follows:
- Recovering a deposit paid at auction where Japanese knotweed had been hidden prior to the auction.
- Demonstrating that works undertaken by an adjacent landowner had caused Japanese knotweed to encroach onto our client’s property.
- Demonstrating that a claim of encroachment against our client was based on ‘skewed’ evidence that had not considered the history of the claimant’s property or the works undertaken by the claimant to hide evidence of knotweed on their land that may have demonstrated that they were the source of the infestation.
- Agreeing with a claimant that Japanese knotweed had encroached from our client’s property, but demonstrating that the claim was overvalued by £23,000.
